Winding up Application, the procedure followed during the hearing

A winding-up Application (petition) under the scope of Article 211 of Chapter 113, is an originating summons as interpreted by Order.2 R.2 of the Civil Procedures Rules. Therefore, it is clear that such petitions differ from any other interim applications or applications by summons which are filed under other procedure rules and which have been already initiated and governed by Order 48 of the Civil Procedures Rules.

Regulation (EU) 2016/1103 on matrimonial property regimes

On 24 June 2016 the EU Council adopted two new Regulations a) the Regulation 2016/1103 which covers marriage issues and b) the Regulation 2016/1104 that covers registered partnerships. Both regulations aim to create certainty about the applicable property law for the couples who enter into a marriage or registered partnership of a cross-border nature. The new rules will only apply to marriages and registered partnerships entered or commenced after 29 January 2019, and only in the Member States which have acceded to the Regulations.
