Promoting Breastfeeding at Work: New Developments.

Introduction
Recent legislative changes in Cyprus have introduced new obligations for employers to promote and facilitate breastfeeding in the workplace. These changes are part of a broader strategy to support maternal health and child development, aligning with international standards and recommendations from the World Health Organization (WHO). This article outlines the new obligations for employers, compliance timeframes, changes from previous regulations, applicable exemptions, and fines for non-compliance.

New Obligations for Employers
Under the new regulations, employers are required to provide designated breastfeeding rooms or areas for nursing mothers. These rooms must meet specific minimum requirements to ensure functionality and privacy. The room must be located within the workplace premises, easily accessible, and provide adequate privacy for nursing mothers. Additionally, the room must be equipped with necessary facilities such as seating, a table, a waste bin, and access to a sink with running water for handwashing and cleaning purposes. Employers must also ensure that a refrigerator is available for the safe storage of expressed breast milk.

Changes from Previous Regulations
The 2025 regulations build upon the existing framework established by the 2018 law. The key changes include more detailed specifications for the breastfeeding rooms, such as the requirement for a minimum room size and specific amenities. The new regulations also emphasize the need for employers to inform their employees about the availability and location of these facilities immediately upon hiring and after returning from maternity leave.

Applicable Exemptions
Certain exemptions apply under the new regulations. Employers with workplaces that have a total area of 50 square meters or less are exempt from creating a permanent breastfeeding room. Additionally, if multiple small workplaces are located within the same building, they may share a common breastfeeding room, provided it meets the minimum requirements.

Compliance Timeframes
These new obligations will come into effect 12 months after their publication in the Official Gazette, which was on July 4, 2025. Therefore, employers have until July 2026 to comply with these requirements.

Fines for Non-Compliance
Non-compliance with the new regulations can result in significant financial penalties. Employers who fail to adhere to the requirements may face fines of up to €7,000 for a first offense. Subsequent offenses can incur fines of up to €8,000.

Conclusion
The new regulations represent a significant step forward in promoting breastfeeding in the workplace, ensuring that nursing mothers have the necessary support and facilities to continue breastfeeding upon returning to work. Employers are encouraged to review these new obligations and take the necessary steps to comply within the stipulated timeframe to avoid penalties and contribute to the well-being of their employees and their families.
